Celebration.com ("Company," "we," "us") respects the intellectual property rights of others and expects users of our platform to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512, "DMCA"), the text of which may be found on the U.S. Copyright Office website, the Company will respond expeditiously to claims of copyright infringement committed using the Company service and/or the Celebration.com website (the “Site”) if such claims are reported to the Company’s Designated Copyright Agent as described below. Upon receiving a valid notice, the Company will take whatever action it deems appropriate in its sole discretion, including removal of, or termination of access to, the allegedly infringing material.
DMCA Notice of Alleged Infringement
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report any alleged infringements taking place on the Site by sending a request via electronic form or written notice to our Designated Copyright Agent that includes the following information (per 17 U.S.C. § 512(c)(3)):
- The physical or electronic signature of the copyright owner or the person authorized to act on the owner’s behalf;
- Identification of the copyrighted work claimed to have been infringed, or a representative list of such works;
- The URL or Internet location of the allegedly infringing material, or information reasonably sufficient to permit us to locate the material on the Site;
- Your name, address, phone number, and email;
- A statement by you that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its authorized agent, or the law; and
- A statement by you, made under penalty of perjury, that the above information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

DMCA Counter-Notices
If you believe your content was removed in error or due to misidentification, you may submit a DMCA counter-notice with the Company by providing the following information to the Designated Copyright Agent:
- Your physical or electronic signature;
- A description of the removed material and its prior location (e.g., URL) on the Site;
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled because of mistake or misidentification;
- Your name, address, phone number, and email; and
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, and a that you will accept service of process from the person who provided the original DMCA notice of the alleged infringement.
Upon receipt of a valid counter-notice, we will forward it to the notifying party who submitted the original DMCA notice. The original notifying party will then have 10 days to notify us that they have filed legal action relating to the allegedly infringing material. If the Company does not receive any such notice, we may restore the content within 10–14 business days.
Repeat Infringer Policy
In accordance with the DMCA, Celebration has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users of our services or the Site who are determined to be repeat infringers. Celebration reserves the right to define the criteria by which Celebration will determine that a person is a “repeat infringer.” Without limiting the Celebration’s right to define “repeat infringer,” as a general rule, a user may be considered a repeat infringer if Celebration receives two (2) or more valid DMCA takedown notices identifying content uploaded by that user. We reserve the right to terminate any account at any time if we determine, in our sole discretion, that the user is a repeat infringer or has otherwise engaged in copyright infringement.
